Agreement to Terms

By accessing or using the Nitreous website and services, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you are prohibited from using or accessing our services. These Terms of Service constitute a legally binding agreement between you and Nitreous.

Description of Services

Nitreous provides general merchandise export services including, but not limited to, sourcing, consolidation, and quality control. We act as an intermediary between suppliers/manufacturers and our clients, facilitating the procurement and shipment of goods to international destinations.

User Responsibilities

By using our services, you agree to:

• Provide accurate, current, and complete information when contacting us or placing orders
• Comply with all applicable local, state, national, and international laws and regulations
• Not use our services for any unlawful or unauthorized purpose
• Not engage in any activity that could damage, disable, or impair our website or services
• Ensure that all products ordered comply with import regulations of the destination country

Orders and Payments

• All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion.
• Pricing is subject to change without notice. The final price will be confirmed at the time of order confirmation.
• Payment terms will be agreed upon prior to the commencement of services. Full or partial payment may be required in advance.
• All fees are non-refundable unless otherwise stated in writing.

Shipping and Delivery

Nitreous will make reasonable efforts to ensure timely delivery of goods. However:

• Delivery dates are estimates and not guaranteed. Delays may occur due to customs, weather, carrier issues, or other factors beyond our control.
• Risk of loss and title to products pass to the buyer upon delivery to the shipping carrier.
• It is the client's responsibility to ensure proper import documentation and compliance with customs regulations in the destination country.

Quality Control

While Nitreous conducts quality inspections on merchandise, we do not guarantee that all products will be free from defects. Our quality control services are performed to the best of our ability based on industry standards. Claims regarding product quality must be made within 14 days of receipt of goods, accompanied by photographic evidence.

Limitation of Liability

To the fullest extent permitted by law, Nitreous shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with the use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

Intellectual Property

All content on the Nitreous website, including text, graphics, logos, and images, is the property of Nitreous and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

Indemnification

You agree to indemnify, defend, and hold harmless Nitreous, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of our services or violation of these Terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Wilmington, Delaware.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after any changes constitutes acceptance of the new Terms.
